How Family Law Proceedings Work

Family law disputes carry personal consequences as heavy as their legal ones. Where the marriage has lasted at least one year and the spouses agree on divorce and its consequences (custody, alimony, division of assets), an uncontested divorce is possible and is often concluded in a single hearing. Where no agreement can be reached, a contested divorce action is filed, and the outcome frequently turns on evidence and witness strategy.

Evidence in the Division of Assets

Under the participation in acquired property regime, assets acquired during the marriage are shared between the spouses upon liquidation. Collecting evidence early, such as land registry records, bank statements, loan payments and company shares, is decisive for calculating the participation claim correctly. Claims relating to the liquidation of the property regime are subject to a ten-year limitation period from the date the divorce judgment becomes final.

The Best Interests of the Child

In custody and contact arrangements, the court's guiding criterion is the best interests of the child. Social inquiry reports, the child's daily life and each parent's circumstances must therefore be handled with care. Conducting the process in the least distressing way for the child is an integral part of the legal strategy.

Important: Divorce and custody are matters the parties cannot freely dispose of, so they are not suitable for mediation. Interim measures such as interim maintenance and use of the family home should be requested together with the action.
