Is a Refund Possible in Crypto Fraud?

The first question every victim of crypto fraud asks is: "Will I get my money back?" The honest answer: every case is different and there is no guarantee — but the chances of recovery rise significantly with the right, swift steps. In this article, we explain under what conditions a refund is possible and how the process is conducted.

What Does a Refund Depend On?

The Legal Process: Two Parallel Paths

1. The Criminal Law Path

A criminal complaint is filed with the Public Prosecutor's Office for qualified fraud (TCK Art. 158/1-f). During the investigation, MASAK traces the funds; under CMK Art. 128/A, the seizure (freezing) of the account holding the funds may be requested. As a victim, you have rights to request evidence and participate in the process under CMK Art. 234.

2. The Civil (Compensation) Path

If the perpetrator is identified, you may bring a claim based on tort provisions (TBK Art. 49) to compensate for the loss you suffered. A precautionary attachment may be requested to prevent the perpetrator's assets from being concealed.

What to Do in the First 48 Hours

Freeze the Evidence

Record everything: transaction IDs (TxID), sender/recipient wallet addresses, all correspondence with the platform and fraudster, and bank receipts.

Notify the Exchange

Make an official report to the support unit of the exchange where the transaction took place; most platforms have an objection mechanism within a certain period.

Criminal Complaint and MASAK

Apply to the Public Prosecutor's Office without losing time. Criminal complaints supported by on-chain analysis significantly increase the chance of success.

A Realistic Expectation

Blockchain transactions are irreversible; therefore a refund may not always be possible. However, there are recovery examples in cases where funds reached a centralised exchange, the perpetrator was domestic, or rapid intervention was possible. What matters is acting with a realistic expectation but with determination and the right steps.

Beware of secondary fraud: Fake recovery services demanding an upfront fee with the claim of "recovering your lost crypto" target victims a second time. Do not fall for such offers.
